Hearing for Attempted Kidnap Suspect
The man accused of trying to abduct a 12-year-old girl in Munising in November 2011 was in court today.
41–year–old Mohamed El Fechtali had a motion hearing about a confession he allegedly gave during a videotaped police interview.
Judge William Carmody tossed out the video as evidence earlier this year, claiming El Fechtali was essentially in custody without being read his Miranda rights.
Alger County Prosecutor Karen Bahrman appealed the ruling.
In October, the Michigan Court of Appeals agreed with her.
They sent the case back to Judge Carmody, leaving it to him to determine whether or not the alleged statement was voluntary.
Judge Carmody is scheduled to make his decision within the next 40 days.
El Fechtali is charged with attempted kidnapping and enticing a child for immoral purposes.
He lives in the Canadian province of Quebec, and he holds citizenship both in Canada and in his native country, Morocco.
