Three U.P. Applebee’s restaurants named in lawsuit
A lawsuit has been filed against a major restaurant chain that has three location in Upper Michigan.
Miller Apple, L.P. operates more than 20 Applebee’s Neighborhood Bar and Grills in Michigan. The company has been named as the defendant in a civil actions suit under the Fair Labor Standards Act.
The company has been accused of requiring tipped employees to perform duties that are non–tipped duties without receiving proper compensation.
The FLSA is a law that requires employers to pay all hourly employees at minimum wage unless those employees receive tips and qualify for “tip credit.”
Current and former employees affected by this are being notified by a Chicago law firm for participation in the collective compensation suit.
A spokesperson for the company that owns the locations in Marquette, Houghton, and Sault Ste. Marie told ABC 10 they have no comment on the issue.
