Cease-and-Desist Order Against Portage Twp. Quarry
A judge issues a cease-and-desist order to force a gravel pit in Portage Township to stop operating.
Circuit Judge Roy Gotham has ruled in favor of residents who live near the gravel pit in a lawsuit.
Last September, they sued VVQ Land Holdings, LLC and Thomas Moyle, Jr., Inc., who operated Valley View Quarry.
Kevin Grzelak, Emily Betterly and Victor Betterly said the quarry was a nuisance because of excessive noise, dust and vibration.
Portage Township agreed and joined in the lawsuit.
Their attorneys argued that local zoning laws barred anything like the quarry from the neighborhood.
Judge Gotham agreed and issued the cease-and-desist order against the quarry today as part of an 11-page ruling.
